PRIVACY ACT STATEMENT
This statement is provided pursuant to the Privacy Act of 1974, 5 USC § 552a.
AUTHORITY:
Section 4214, Public Law 109–59, 119 Stat. 1144, 1759–1760, codified at 49 U.S.C. 14701, the Safe, Accountable Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA–LU).
PURPOSE:
To file and log consumers, drivers and industry complaints relating to truck and bus safety and household goods motor carriers for the purpose of compiling or linking complaint information gathered by FMCSA and States with regard to such carriers.
ROUTINE USES:
The information is used for the purpose set forth above and may be forwarded to Federal, State, and local government agencies for the purposes of enforcing the safety of motor carriers, buses, and HHG transporters. Information may also be shared with the accused party in the course of an investigation if such information is determined to be essential to the furthering the investigation.
In addition to those disclosures permitted under 5 USC 552a(b) of the Privacy Act of 1974, additional disclosures may be made in accordance with the U.S. Department of Transportation (DOT) Prefatory Statement of General Routine Uses published in the Federal Register on December 29, 2010 (75 FR 82132), under ‘‘Prefatory Statement of General Routine Uses’’ (available at http://www.dot.gov/privacy/privacyactnotices).
DISCLOSURE:
Voluntary, however, failure to provide information will result in delay in processing the complaint.
